Sus datos serán tratados para las siguientes finalidades: 1.- Finalidad Primaria. LE BLANC tratará sus datos personales con la finalidad de gestionar la compra y entrega de los productos que ofrece a través de sus plataformas, principalmente su sitio web sitio web https://blancfloreria.com.mx/, y brindarle mayor información respecto de los mismos, para procurar una mejor atención y comunicación con usted, así como para realizar los cobros de los productos solicitados. 2.- Finalidades Secundarias. LE BLANC podrá tratar sus datos personales para llevar a cabo alguna o todas de las siguientes finalidades que no necesariamente derivan del procesamiento de una solicitud de información o cotización sobre un producto que se haya ofrecido a través de la página, como son: conocer sus dudas, necesidades y opiniones, hacer de su conocimiento nuevos productos, ofertas, promociones y proyectos, así como verificar su identidad. Al ingresar a la plataforma https://blancfloreria.com.mx/ y llenar el formulario para realizar el pedido o compra de los productos que se ofrecen; o bien, si nos contacta vía telefónica, vía correo o vía WhatsApp. Los datos personales que obtiene LE BLANC son: ✓ Datos de identificación y contacto: nombre y domicilio completo; número telefónico (local y móvil), correo electrónico, empresa para la cual labora y nombre completo de quién recibe el producto, así como su dirección completa, correo electrónico y número telefónico. ✓ Datos financieros. Nombre del Titular de la Cuenta bancaria, número de tarjeta bancaria, fecha de expiración y en su caso código de seguridad (CVV) y/o clave dinámica (token). Ello para hacer los pagos de servicios por en línea, lo cual se realiza a través del agregador Conekta, quien se obliga a utilizar los datos únicamente para los fines establecidos. ✓ Datos Fiscales: Registro Federal de Contribuyentes (RFC), Comprobante Fiscal Digital por Internet (CFDI) o datos de uso de CFDI, domicilio fiscal, correo de envío de facturas. Lo anterior a efecto de expedir el comprobante de pago o la factura correspondiente. ¿Recaban y tratan datos personales sensibles? Es importante puntualizar que, LE BLANC NO recaba ni trata por medio alguno información que revele aspectos de origen racial o étnico, información genética, creencias religiosas, filosóficas y morales, afiliación sindical, opiniones políticas o preferencia sexual. De igual forma, es importante indicar que LE BLANC, aunque solicita los datos bancarios dentro de la plataforma https://blancfloreria.com.mx/finalizar-compra/ para realizar el cobro de los productos, estos son recabados y tratados directamente cuando se concrete la compra-venta a través del agregador Conekta, cuyo aviso de privacidad se encuentra en su página oficial https://www.conekta.com/legal/privacy, términos y condiciones https://www.conekta.com/legal/tos y el cual estará a su disposición antes de ingresar tus datos bancarios. ¿Mis datos pueden ser transferidos o compartidos dentro del país o en el extranjero? No. Los datos personales que se recaban, en ningún caso serán compartidos dentro o fuera del país; en este sentido, el único responsable del tratamiento de su información será en todo momento LE BLANC y en su caso el agregador Conekta para efectos del cobro. Por su parte, es importante indicar que los datos bancarios que se recaban a través del agregador Conekta, son utilizados para realizar el cobro del producto que adquiriste con nosotros; estos datos recabados y tratados directamente por la sociedad GRUPO CONEKTAME, S.A. DE C.V., quien asume toda la responsabilidad en su uso, manejo y confidencialidad, obligándose a tratarlos única y exclusivamente para que se pueda realizar el cargo de los producto adquiridos a través de nuestra página de internet y/o “plataformas”. ¿Puedo manifestar mi negativa en utilizar mis datos personales para finalidades secundarias o accesorias? En caso de que no desee que sus datos personales sean tratados para las finalidades secundarias, usted puede desde este momento enviar un correo a nuestra dirección contacto@blancfloreria.com.mx., manifestando lo anterior, a efecto de que se tomen las anotaciones correspondientes. Si usted no manifiesta su negativa para dichas finalidades, en un plazo de 5 días hábiles a partir de que se recabaron sus datos personales, entenderemos que nos ha otorgado su consentimiento tácito. ¿Cuáles son los medios para ejercer mis derechos de Acceso, Rectificación, Cancelación y Oposición al tratamiento de mis datos? Acceso. El Titular tiene derecho a que LE BLANC elimine de sus bases de datos, cuando éste considere que su información no está siendo utilizada conforme a los principios, deberes y obligaciones previstas en las normativas de protección de datos. Oposición. El Titular tiene derecho a oponerse al uso de sus datos personales para fines específicos. Todos estos derechos son conocidos como ARCO y puede hacerlos valer en cualquier momento, al igual que su derecho de revocar el consentimiento que hubiese sido otorgado con anterioridad y que hubiera sido necesario para el tratamiento de los datos del menor, así como limitar el uso o divulgación de los mismos. Lo anterior, se realiza mediante una petición, que se ingresa personalmente ante la Unidad Especializada de Atención al Público, cuyos datos aparecen al principio del presente aviso, o enviando una petición o solicitud vía correo electrónico a la siguiente dirección: contacto@blancfloreria.com.mx. La petición deberá ser ingresada a través de un escrito libre, sencillo y breve, en el cual el titular tendrá que: (i) describir con precisión cual o cuales de los derechos ARCO desea ejercer; (ii) señalar respecto de qué datos personales se desea ejercer los derechos ARCO; (iii) aportar cualquier elemento o documento que facilite la localización de los datos personales; (iv) acreditar correctamente su identidad como representante legal del menor; y (v) proporcionar dirección y correo electrónico de contacto para efectos de enviar respuesta a la petición. El plazo máximo de respuesta a su petición es de 20 días, contados a partir de la fecha en que se recibió la solicitud, informándole sobre la procedencia o no de la misma, mediante el correo electrónico que nos fuere proporcionado al ingresar su petición. Cabe señalar que el ejercicio de los derechos ARCO, o bien el derecho de revocación de consentimiento es gratuito, en el entendido que LE BLANC podrá solicitarle el pago únicamente de los gastos justificados de envió o costos de reproducción de la información que solicite. En caso de ejercer el derecho de acceso a la información y haberse emitido resolución favorable, LE BLANC enviará dentro de los 15 (quince) días hábiles siguientes a la fecha de respuesta, los datos personales solicitados. De igual manera, el envío de estos será a través de correo electrónico. En caso de requerir la expedición de copias simples, el interesado deberá manifestarlo de esta manera dentro de su solicitud, con el fin de prepararlas, calcular los costos de reproducción y comunicarle el lugar y horario de la entrega de los datos. Se le comunica que no en todos los casos podremos atender su solicitud o concluir el uso de forma inmediata, ya que es posible que por alguna obligación contractual requiramos seguir tratando sus datos personales. De igual forma, usted deberá considerar que, en ciertos casos, la revocación de su consentimiento implicará que no podamos continuar con la petición de información y/o cotización de los productos y/o servicios ofrecidos mediante la plataforma.
